Synchrony's terms govern your financing relationship with them; O'Leary Plumbing, Heating & Electrical is not a lender.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS WEBSITE OR YOUR USE OF INFORMATION ON IT WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US FOR SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM. Liability for our service work performed in your home is governed by the workmanship warranty in Section 7 and is not limited by this Section 14. Nothing in these Terms limits any liability that cannot be excluded by law (including, where applicable, liability for personal injury caused by negligence, fraud, or any non-waivable consumer-protection right under Wisconsin law).

15. Indemnification

You agree to defend, indemnify, and hold harmless O'Leary Plumbing & Heating, Inc., its officers, employees, and agents, from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to (a) your violation of these Terms, (b) your misuse of the website, or (c) your violation of any third party's rights.

16. Governing Law & Venue

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws principles. Subject to the arbitration agreement in Section 17, the exclusive venue for any dispute not subject to arbitration is the state or federal courts located in Walworth County, Wisconsin. You consent to personal jurisdiction in those courts.

17. Binding Individual Arbitration & Class-Action Waiver

We will try to resolve any dispute informally first. If we cannot resolve it within 60 days after written notice, any dispute, claim, or controversy arising out of or related to these Terms, the website, or your use of AI-assisted content (other than (i) the warranty for service work in your home under Section 7, (ii) small-claims-court matters within the court's jurisdictional limit, or (iii) injunctive or other equitable relief for infringement of intellectual-property rights) will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Walworth County, Wisconsin, or by phone/video if you prefer. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.

Class-action waiver. You and we each waive the right to bring or participate in any class, collective, consolidated, or representative action. The arbitrator may not consolidate claims and may not preside over any form of representative or class proceeding.

30-day opt-out. You may opt out of this arbitration agreement by emailing [email protected] with "Arbitration Opt-Out" in the subject line and your full name + service address in the body within 30 days after first accepting these Terms. Opting out does not affect any other provision of these Terms and will not negatively affect our relationship.

18. Notice & Dispute Procedure

Any notice or dispute notice required under these Terms must be in writing and sent to O'Leary Plumbing & Heating, Inc., 2720 Buell Drive, East Troy, WI 53120, with a copy to [email protected]. A notice must include your name, service address, a clear description of the issue, and the relief you are requesting.

19. Termination
